TERMS OF SERVICE

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and OVRN HOUSE ("we," "our," or "us"), governing your access to and use of the website ovrn.in (the "Platform") and any purchase of products offered thereon. By accessing the Platform, creating an account, or placing an order, you confirm that you have read, understood, and unconditionally agree to be bound by these Terms. If you do not agree with any provision of these Terms, you must immediately cease use of the Platform and refrain from placing any orders.

You must be at least thirteen (13) years of age to use the Platform. Users between the ages of thirteen (13) and seventeen (17) may use the Platform only with the prior consent of a parent or legal guardian, who shall be bound by these Terms on their behalf. By using the Platform, you represent and warrant that you meet the eligibility requirements set out herein. We reserve the right to terminate accounts found to be in violation of this requirement without notice.

Access to the Platform requires authentication via Google OAuth 2.0. By registering, you agree to provide accurate and complete information and to keep your linked Google account secure. You are solely responsible for all activity that occurs under your account. OVRN HOUSE reserves the right to suspend or permanently terminate your account, without prior notice or liability, in any of the following circumstances:

1. 01.You engage in fraudulent activity, including but not limited to placing orders with no intent to receive goods, submitting false exchange claims, or providing misleading personal information.
2. 02.You engage in abusive, harassing, or threatening conduct toward our staff, delivery partners, or other users.
3. 03.You attempt to circumvent Platform security, manipulate drop access systems, or use automated tools, bots, or scripts to interact with the Platform.
4. 04.You violate any provision of these Terms or any applicable law or regulation.

OVRN HOUSE operates on a limited-drop model. All products are offered in finite quantities. The display of a product on the Platform does not constitute an offer or guarantee of its availability. We reserve the right to limit the quantity of items purchased per customer per drop, to prevent stockpiling or scalping. Completion of a purchase does not guarantee fulfilment if we identify, in our sole discretion, a legitimate reason to cancel the order, including but not limited to suspected fraudulent activity or a pricing or stock error on the Platform.

All orders placed on the Platform are subject to acceptance and product availability. By submitting an order, you make an offer to purchase the selected item at the stated price. A contract between you and OVRN HOUSE is formed only upon our written or electronic confirmation of your order. The following terms apply to all transactions:

1. 01.All prices are displayed in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST) unless expressly stated otherwise.
2. 02.Payment is processed exclusively through Razorpay. By proceeding to payment, you agree to Razorpay's Terms of Service available at razorpay.com/terms.
3. 03.All sales are final upon payment confirmation. Orders cannot be cancelled, modified, or refunded once payment has been successfully processed, except where a product is found to be significantly defective or materially different from its description, as set out in Section 07.
4. 04.We reserve the right to refuse or cancel any order at our sole discretion, including where a payment is suspected to be fraudulent, where a pricing error has occurred, or where stock discrepancies arise after the order is placed.

In the event that a payment transaction fails after funds have been debited from your account, the following applies:

1. 01.Payments are processed by Razorpay on its PCI DSS-compliant infrastructure. OVRN HOUSE does not receive, hold, or control payment funds directly.
2. 02.Where a payment is debited but no order confirmation is issued, Razorpay's automated systems will typically initiate a refund to the original payment source within five (5) to seven (7) business days, subject to your bank's processing times.
3. 03.If you believe a payment has been debited in error and no refund has been received within ten (10) business days, please contact us at contact@ovrn.in with your transaction reference details. We will coordinate with Razorpay to investigate the matter.
4. 04.OVRN HOUSE is not liable for delays in refunds attributable to Razorpay's systems, your bank, or other third-party payment infrastructure beyond our reasonable control.

We make every effort to accurately represent our products on the Platform. However, by placing an order, you acknowledge and accept the following:

1. 01.Colour Variations — product colours as displayed on the Platform are subject to variation depending on your device's screen calibration, brightness settings, and display technology. Minor differences between the colour shown online and the physical product do not constitute a defect and do not entitle you to an exchange.
2. 02.Material & Sizing Variations — minor variations in fabric texture, weight, or measurements that fall within standard manufacturing tolerances are inherent to garment production and do not constitute a defect.
3. 03.Significant Discrepancies — where a product is materially and significantly different from its description (for example, receiving an incorrect item or a product with a manufacturing defect that renders it unwearable), you may be eligible for an exchange subject to the conditions set out in our Exchange Policy available at ovrn.in/exchange.
4. 04.All exchanges remain subject to the eligibility conditions, time limits, and item condition requirements stated in our Exchange Policy.

OVRN HOUSE ships domestically within India and internationally to select destinations. All delivery timelines communicated on the Platform are estimates only and are not contractual guarantees. The following conditions apply:

1. 01.OVRN HOUSE partners with third-party courier and logistics providers for all shipments. Once an order is dispatched, delivery is the responsibility of the courier partner.
2. 02.We are not liable for delays arising from causes beyond our reasonable control, including but not limited to courier operational delays, public holidays, adverse weather, customs clearance procedures, or other force majeure events.
3. 03.International orders may be subject to import duties, customs taxes, and local levies imposed by the destination country. These charges are the sole responsibility of the recipient and are not included in the purchase price.
4. 04.Risk of loss and title for products pass to you upon dispatch of the order to the courier partner.

All content on the Platform, including but not limited to product designs, garment graphics, photography, brand identity elements, typography, logos, trade names, and written content (collectively, "OVRN Intellectual Property"), is the exclusive property of OVRN HOUSE and is protected under applicable Indian and international intellectual property laws. The following conduct is strictly prohibited:

1. 01.Reproducing, copying, imitating, or manufacturing any OVRN HOUSE design, garment, or brand asset without our express prior written consent.
2. 02.Using the OVRN HOUSE name, logo, or any other brand identifier in any commercial context without our express prior written consent.
3. 03.Reselling, distributing, or commercially exploiting OVRN HOUSE products acquired through the Platform, including resale for profit on secondary markets, without our express prior written consent.
4. 04.Scraping, data-mining, or extracting any content from the Platform by automated means.

In addition to the conduct prohibited under Section 03, the following activities are expressly forbidden on or in connection with the Platform:

1. 01.Creating multiple accounts for the purpose of circumventing per-customer purchase limits on limited-edition drops.
2. 02.Using automated purchasing tools, browser extensions, or bots to gain an unfair advantage in accessing limited-drop inventory.
3. 03.Engaging in any activity that interferes with or disrupts the Platform's infrastructure, security, or performance.
4. 04.Submitting false, misleading, or fraudulent exchange requests.
5. 05.Impersonating any person or entity, or falsely representing your affiliation with OVRN HOUSE.

To the maximum extent permitted by applicable law, OVRN HOUSE provides the Platform and its products on an "as is" and "as available" basis, without warranties of any kind, express or implied. Specifically:

1. 01.We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.
2. 02.We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or the purchase of products, including loss of profits, loss of data, or loss of goodwill.
3. 03.Our total aggregate liability to you for any claim arising under or in connection with these Terms shall not exceed the total amount paid by you for the specific order giving rise to the claim.
4. 04.Nothing in these Terms limits our liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot lawfully be excluded or limited.

OVRN HOUSE shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, epidemic or pandemic, strikes or industrial action by courier or logistics providers, government restrictions, import/export embargoes, or failure of third-party infrastructure including payment processors or telecommunications networks. In such circumstances, our obligations shall be suspended for the duration of the event.

We reserve the right to amend, update, or replace these Terms at any time at our sole discretion. Any revised Terms will be published on the Platform with an updated version number and effective date. Your continued use of the Platform following the publication of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must discontinue your use of the Platform. We may, where reasonably practicable, notify registered users of material changes via the email address associated with their account.

These Terms shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of laws principles. Any dispute, claim, or controversy arising out of or in connection with these Terms, including any question as to their formation, validity, interpretation, performance, breach, or termination, shall be submitted to the exclusive jurisdiction of the courts of competent jurisdiction in Guwahati, Assam, India. By using the Platform, you irrevocably submit to the personal jurisdiction of such courts and waive any objection to the laying of venue of such proceedings in Guwahati.
